PRESENTER BIO:  Laura St. John is the Managing Attorney with the
Florence Immigrant and Refugee Rights Project.  She has been with the
Florence Project for four years, working extensively with adult
immigrants detained during their removal proceedings by ICE in the
four immigration detention centers in Arizona (located in Eloy and
Florence).  Before coming to the Florence Project, Laura worked with
Centro de los Derechos del Migrantes, a non-profit in Zacatecas,
Mexico assisting Mexican nationals who, after returning from the U.S.,
had claims under U.S. employment and labor law.

TOPIC: The training will provide an overview of the immigration
consequences of a criminal conviction, including how to apply the
categorical and modified categorical approach to analyze the
immigration consequences of a state conviction.  The goal of the
training is to help practitioners understand 1) the basic ways in
which a criminal conviction may affect an individual’s immigration
case, 2) whether a conviction is likely to be treated by DHS as an
offense that will trigger immigration consequences, and 3) how to
argue that a criminal conviction does not, or should not, have
immigration consequences in terms of removability and/or eligibility
for immigration relief.  This CLE will address the Supreme Court’s
decisions in Moncrieffe v. Holder and Descamps v. United States, both
of which clarified the categorical approach and opened doors for new
arguments challenging immigration consequences for many convictions.

Handouts will include a training guide to the categorical approach and
a sample motion to terminate.
